Data Contribution Terms
1. What this covers
These Data Contribution Terms are entered into between the organization submitting data and the operator of Outcomp ("Outcomp", "we", "us").
When you submit an invoice, rate card, or related commercial pricing data to Outcomp ("Contributed Data"), these terms govern how that data is used. This is distinct from personal data (like your email address), which is covered by our Privacy Policy.
By submitting Contributed Data to Outcomp, you agree to these terms on behalf of the organization you represent and confirm that you have the authority to do so.
2. What Outcomp does with Contributed Data
Outcomp de-identifies and aggregates Contributed Data to (a) prepare your individual benchmark report, and (b) build and improve the shared Outcomp market benchmark made available to other customers.
You retain ownership of your original Contributed Data. You grant Outcomp a worldwide, non-exclusive, irrevocable, royalty-free license to process Contributed Data for the purpose of creating de-identified and aggregated Benchmark Data. Once Contributed Data has been de-identified and incorporated into Benchmark Data, so that your company cannot reasonably be identified as its source, Outcomp may retain and use that Benchmark Data indefinitely for benchmarking, analytics, product development, and related business purposes. Outcomp owns the Benchmark Data, benchmark methodology, normalized taxonomies, models, and analyses it creates, without affecting your ownership of your original data.
Confidentiality. Outcomp treats identifiable Contributed Data as confidential business information and uses it only as described in these terms.
AI processing. Outcomp may use automated systems and AI-assisted tools to extract, classify, normalize, and validate submitted data. Raw Contributed Data is not used to train third-party general-purpose AI models. De-identified Benchmark Data may be used to improve Outcomp's own models, methodology, and products.
Using your report. You may use your benchmark report for your own internal procurement, budgeting, and negotiation purposes, and may share reasonable extracts with your suppliers and professional advisers for those purposes. Benchmark Data may not be resold, systematically extracted, republished as a database, or used to build a competing benchmarking service without Outcomp's permission.
Deletion. You may ask us to stop using your Contributed Data in future benchmark calculations at any time by contacting data@outcomp.ai. Outcomp may retain original submitted documents for as long as reasonably necessary for validation, quality assurance, and security, after which they are deleted or archived in accordance with Outcomp's retention practices. This does not require Outcomp to withdraw Benchmark Data already produced before your request. Once your data has been de-identified and aggregated into a benchmark, it generally cannot be extracted without compromising the anonymity of other contributors.
3. How individual companies are protected (competition law safeguards)
These principles should be treated as product requirements, not just legal text. They need to be reflected in how the benchmark actually displays data, not only in what this document says.
Aggregation only. Outcomp never displays an individual contributor's exact price to another customer. Benchmarks are shown as ranges, percentiles, or medians (e.g. "Market 25th percentile"), never as an attributable single data point.
Minimum cohort size, per filter combination. Outcomp will not display a benchmark unless the specific segment, including any combination of filters applied, contains data from at least 5 independent contributors. Outcomp may broaden, suppress, delay, or withhold a benchmark where a narrower segment could reasonably allow a contributor's data to be inferred.
Contributor dominance controls. Multiple invoices or observations from the same company do not increase the contributor count. Outcomp applies weighting and suppression controls so that no individual contributor can disproportionately influence a displayed benchmark.
No individualized access. Contributors only ever see aggregated market data. They never see another named contributor's individual pricing, terms, or identity.
Protection against re-identification. Outcomp may limit, combine, suppress, delay, or refuse benchmark queries or segments where repeated queries, narrow filtering, or other techniques could reasonably be used to infer an individual contributor's data.
No forward-looking information. Outcomp does not publish prospective prices, planned price changes, future purchasing intentions, future volumes, negotiation strategies, or other forward-looking commercial information. Benchmark data reflects historical observations, and Outcomp may apply publication delays or broader historical windows where necessary to reduce the risk that current commercial information could be inferred.
Independent decision-making. Benchmarks are informational only. Customers independently determine whether and how to use them. Outcomp does not coordinate purchasing strategies, negotiation positions, supplier selection, or commercial conduct between customers.
Only what's needed to benchmark. Outcomp collects operational metrics reasonably necessary to normalize and compare pricing, such as historical order volumes, pallet usage, shipment characteristics, or service levels. Outcomp does not require contributors to provide future forecasts, strategic plans, future purchasing intentions, or other information unnecessary for benchmarking.
Uploaded is not the same as benchmark-eligible. A submitted invoice only becomes a benchmark observation after it passes review: extraction is checked, currency and date are confirmed, and duplicates or non-representative entries (such as credit notes) are excluded.
Raw invoices and the benchmark database are separate. Original submitted files (which may contain names, contact details, invoice numbers) are stored separately from the normalized, de-identified observations used in benchmarks. Direct personal identifiers are removed before observations enter the benchmark database.
4. Your responsibility for what you submit
By submitting data to Outcomp, you represent that you have the right and authority to share it for the purposes described here. For example, sharing it must not breach a confidentiality obligation or NDA you hold with your 3PL provider or another third party.
5. What Outcomp does not do
- Outcomp does not sell raw or identifiable Contributed Data, or disclose it to other customers, 3PL suppliers, data brokers, or other third parties for their own purposes. Contributed Data may be processed by vetted service providers acting on Outcomp's behalf where necessary to operate the service, subject to appropriate confidentiality and security obligations, or where disclosure is required by law.
- Outcomp does not accept supplier compensation for benchmark placement, rankings, recommendations, or access to buyer benchmark data. Outcomp is compensated only by the companies using its benchmarks.
- Outcomp does not sell, license, or otherwise provide benchmark data, insights, or reports to 3PL suppliers or other providers. Benchmarks are built for buyers, not sellers.
6. No warranty
Benchmarks and estimates provided by Outcomp are indicative and based on available data at the time of preparation. They do not constitute a guarantee of savings, pricing, or negotiation outcomes, and should not be the sole basis for a business decision.
7. Governing law
These terms are governed by Swedish law. Any dispute arising from these terms is subject to the exclusive jurisdiction of the Stockholm District Court, unless otherwise agreed in writing.
8. Changes to these terms
We may update these terms as Outcomp's product evolves. If a change materially expands how previously contributed data may be used, we will provide reasonable notice before the change takes effect.
